Blogs: Temperature check for MSP & mental capacity and social media
There have been two useful blogs published this week which are worth a look.
The first is by Caroline Norrie (Research Fellow NIHR Health and Social Care Workforce Research Unit (HSCWRU), at the Policy Institute at King’s College London - A ‘temperature check’ survey of local authority staff about implementing Making Safeguarding Personal.
Caroline reviews an article by Cooper and colleagues (2018), which discusses the findings from a telephone survey of 115 local authorities (LAs), about progress implementing ‘Making Safeguarding Personal’ (MSP) in England.
The second blog is by Alexander Shah a trainee solicitor with Wrigleys Solicitors which considers recent linked cases looking at how should capacity to use social media be assessed? Shah's blog looks at two case - Re A: (Capacity: Social Media and Internet Use: Best Interests) [2019] EWCOP 2 and Re B: (Capacity: Social Media: Care and Contact) [2019] EWCOP 3.
Shah notes 'This judgement will doubtless be of significant use to practitioners going forward. Not only are they now able to know exactly what they are assessing capacity for, but they know how to measure it. Furthermore, adult social care services and others will be able to create resources and action plans around this test, with the intent of taking all practical steps to help P make decisions over their social media contact and internet use (as required by Section 1(3) MCA 2005). Hopefully this will result in greater consistency and a reduction in risk to vulnerable adults.'
