Peers debate the Mental Capacity (Amendment) Bill

On Wednesday 5 September Peers considered the Mental Capacity (Amendment) Bill at Committee stage. Peers tabled over 90 separate amendments ahead of the debate and considered a range of topics, including extending the provisions to 16 and 17 year olds, unlawful deprivation of liberty, advanced consent and training for care home managers.

The Local Government Association (LGA) have produced a briefing in advance of the Peers debate. The LGA support Baroness Thornton’s amendment on extending the provisions to 16 and 17 year olds as well as calling for consideration of the impact on local authorities.
